Terms of Service Agreement

PLEASE READ THIS AGREEMENT CAREFULLY. IT INCLUDES A BINDING ARBITRATION CLAUSE AND AFFECTS YOUR LEGAL RIGHTS. BY CLICKING ON “I AGREE TO TERMS AND CONDITIONS” OR BY USING, APPLYING FOR, OR ACCEPTING LUBTFY T/A gabbl.AI ONLINE ACCOUNT OR THE NATURAL LANGUAGE PROCESSING SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS. IF YOU DO NOT AGREE TO THE TERMS, DO NOT USE THESE SERVICES.

1. License

1.1 Grant of License: LUBTFY T/A gabbl.AI grants you a limited, non-exclusive, non-transferable, and revocable license to use its natural language processing services, including associated online services, documentation, files, and website information (collectively, "Services"), solely for creating interfaces for your devices and applications.

1.2 License Tiers: Services are offered in different tiers:

- Basic Services: Provided at no cost.

- Enhanced Services: Require purchase and are contingent upon receipt of applicable fees and taxes.

1.3 Trial and Evaluation: If applicable, licenses for trial, beta, or evaluation purposes will terminate automatically at the end of the trial or evaluation period.

1.4 Restrictions: Licenses are valid only if the Services remain unmodified, retain all copyright and proprietary notices, and are used in compliance with relevant security policies.

2. Services

2.1 Scope of License: The licenses are granted solely for connecting to and using the Services for your personal or internal business purposes.

2.2 Access: Services are accessed via a provided web interface and API. Derivative works from the Interface or Services are not permitted.

2.3 Data Storage: Designated records will be stored and transferred to servers as necessary for service provision. Data is stored and processed by a third party partner; Aminos.ai Ventures Ltd. (aminos.ai). We emphasize strict GDPR compliance, ensuring robust data protection. Data responsibility for issues such as leaks lies with the platform provider (e.g., Aminos.ai Ventures Ltd.) as LUBTFY T/A gabbl.AI is primarily a reseller. Data sharing is restricted to cases with explicit consent, legal requirements, or necessary service provisions as outlined.

2.4 Data Loss: LUBTFY T/A gabbl.AI does not maintain backups of data and does not guarantee against data loss or destruction.

3. Ownership

3.1 Rights: The Services are licensed, not sold. This Agreement confers no ownership rights and grants only a license to use the Services.

4. Payment

4.1 Fees: Fees are as described on the website and must be paid as required for access to Enhanced Services.

5. Use Restrictions

5.1 Lawful Use: The Services may be used only for lawful purposes and in accordance with this Agreement.

6. Warranties and Disclaimers

6.1 As Is: The Services are provided "as is" without any warranties, express or implied.

7. Limitation of Liability

7.1 Exclusions: LUBTFY T/A gabbl.AI does not limit liability for death, personal injury, fraud, or gross negligence.

8. Termination

8.1 Termination: This Agreement is effective until terminated by either party. You may terminate by notifying LUBTFY T/A gabbl.AI.

BY USING, APPLYING FOR, OR ACCEPTING THE SERVICES, YOU CONFIRM YOUR UNDERSTANDING OF THIS AGREEMENT AND AGREE TO ALL ITS TERMS. DO NOT USE THE SERVICES IF YOU DO NOT AGREE.
